SHUNGA TOKYO Terms of Service

Article 1 (Scope of Application)

  1. These Terms of Service define the conditions for the use of the online store of the brand "SHUNGA TOKYO" (shungatokyo.com, hereinafter referred to as "this Site"), operated by the Japan Modern Lifestyle Association (hereinafter referred to as "the Association"), between the Association and all users of this Site (hereinafter referred to as "Users").
  2. By using this Site, Users are deemed to have agreed to these Terms of Service.

Article 2 (Definitions)

The terms used in these Terms of Service shall have the following meanings:

  1. "Products" refers to T-shirts and other items sold by the Association through this Site.
  2. "Members" refers to Users who have registered as members on this Site.
  3. "Personal Information" refers to personal information as defined in Article 2 of the Act on the Protection of Personal Information.

Article 3 (Member Registration and Guest Purchase)

  1. This Site supports both "Guest Purchase," which allows users to purchase products without member registration, and "Member Purchase," which allows users to view purchase history and use other features by registering as a member.
  2. Users who wish to register as a member shall input the required information into the registration form on this Site and complete the registration according to the method specified by the Association.
  3. Members shall promptly update their registration information if there are any changes.
  4. Members are responsible for strictly managing their account information (ID and password) and shall not lend or transfer it to third parties.

Article 4 (Prohibited Actions by Users)

Users shall not engage in any of the following actions when using this Site:

  1. Actions that infringe upon the intellectual property rights, privacy rights, portrait rights, honor, or other rights or interests of the Association or a third party.
  2. Reproducing, modifying, reprinting, distributing, or using for commercial purposes the content of this Site (product images, text, design, brand logo, censorship logo, etc.) without the prior written consent of the Association.
  3. Unauthorized access to this Site, unauthorized login attempts, or actions intended to place an excessive load on the system.
  4. Registering false information.
  5. Impersonation, or actions that destroy or obstruct the functions of the Association's servers or network.
  6. Actions that violate laws or public order and morals.
  7. Other actions deemed inappropriate by the Association.

Article 5 (Formation of Purchase Agreement)

  1. A sales agreement shall be formed between the User and the Association when the User orders a product on this Site and the Association sends an order confirmation email.
  2. The Association may refuse to accept an order if there are unavoidable circumstances such as out-of-stock items or incorrect price indications.

Article 6 (Delivery of Products)

  1. Products will be shipped within 7 to 10 business days after order confirmation. Delivery is estimated to take 1 to 2 weeks after shipment, depending on the delivery region.
  2. Products are manufactured on demand (made-to-order), and the above-mentioned days may be exceeded depending on production and delivery status.

Article 7 (Payment of Price)

  1. Users shall pay the product price, shipping fees, and any other necessary costs by the method designated by the Association at the time of order.
  2. The payment timing for each payment method shall comply with the Act on Specified Commercial Transactions.

Article 8 (Intellectual Property Rights)

  1. Copyrights, trademark rights, and other intellectual property rights related to all content published on this Site (product designs, images, text, brand logos, site structure, etc.) belong to the Association or third parties who hold legitimate rights.
  2. The Association's products are based on "shunga" (erotic art) created during the Edo period (classical art in the public domain). While the copyrights for the original drawings have already expired, the copyrights for the Association's unique reconstruction of colors and graphics, design processing using censorship logos, and creative composition as a product belong to the Association as derivative works or independent creative works under copyright law.
  3. Users shall not reproduce, modify, distribute, or use for commercial purposes the creative works mentioned in the preceding paragraph without the prior written consent of the Association.
  4. The brand name "SHUNGA TOKYO," the product series name "SHUNGA-T," and censorship logos are trademarks or symbols related to the trademark use of the Association.

Article 9 (Handling of Expressions)

The products handled on this Site include artistic works that reconstruct shunga, which depict sexual scenes. Explicit parts in the original drawings are censored with brand logos, and direct sexual depictions are not displayed on the products. Users shall purchase the products with the understanding that such expressions are works in an artistic context.

Article 10 (Disclaimer)

  1. The Association does not guarantee the accuracy, completeness, or usefulness of the content, functions, links, product information, etc. of this Site.
  2. The Association shall not be liable for any delays or damages caused by force majeure (natural disasters, wars, communication failures, payment system failures, etc.).
  3. If damage is incurred by a User due to reasons attributable to the Association, the Association's liability for compensation shall be limited to the product price related to the order concerned.

Article 11 (Changes to Terms)

  1. The Association may change these Terms of Service as necessary.
  2. The revised terms shall become effective from the time they are posted on this Site. For significant changes, members will be notified to the extent possible.

Article 12 (Governing Law and Jurisdiction)

  1. These Terms of Service shall be governed by the laws of Japan.
  2. In the event of a dispute between the Association and a User regarding these Terms of Service or the use of this Site, the Tokyo District Court shall be the exclusive court of first instance.

Supplementary Provisions
These Terms of Service shall come into effect on May 1, 2026.
